# Surf, Skate and BMX Visas for Athletes | P-1A, O-1A and EB-1A

##### Sports Immigration

This page is for surfers, skateboarders, BMX (bicycle motocross) riders and competition climbers who compete in the United States, and for the coaches who travel with them. The visas are explained on the firm's [P-1A](/temporary-visas/p-1-visa/), [O-1](/temporary-visas/o-1-visa/) and [EB-1A for athletes](/eb-1a-green-card-athletes/) pages; below is what these sports raise that a team sport does not. ## How the work reaches the United States

- **Surfing.** The World Surf League's 2026 Championship Tour has 12 stops, and two are in the United States: Lower Trestles, San Clemente (September 11 to 20) and the Banzai Pipeline, Hawaii (December 8 to 20) ([World Surf League, 2026 schedule and formats](https://www.worldsurfleague.com/posts/546281/2026-championship-tour-schedule-and-formats)).
- **Skateboarding.** The 2026 Street League Skateboarding Championship Tour has seven stops; the two in the United States were downtown Los Angeles on April 4 and Tempe on August 29 ([Street League Skateboarding](https://streetleague.com/)).
- **Skateboarding and BMX in the X Games League.** The X Games League's FAQ describes a league launching in summer 2026, with athletes competing "for franchise-owned Clubs under a 3-stop season format" ([X Games League FAQ](https://www.xgames.com/xgl-faq/)). At the league's first draft, at Cosm Los Angeles, four clubs selected "40 athletes representing eight different countries, ages 11-35", and drafted athletes received signing bonuses paid through a crypto wallet platform ([X Games, draft rosters](https://www.xgames.com/news/global-action-sports-team-rosters-officially-locked-for-four-x-games-clubs-at-first-ever-moonpay-x-games-league-draft/)).
- **Climbing.** World Climbing's calendar includes the World Climbing Series Salt Lake City, October 16 to 18, 2026 ([World Climbing](https://www.worldclimbing.com/)).

Those schedules can fit one petition rather than one per event. The P-1 regulation treats a tour, an athletic season or "a group of related activities" as a single event ([8 CFR 214.2(p)(3)](https://www.law.cornell.edu/cfr/text/8/214.2)). An individual athlete's P-1A petition can be approved "for a period up to 5 years" ([8 CFR 214.2(p)(8)(iii)(A)](https://www.law.cornell.edu/cfr/text/8/214.2)) and extended for up to 5 more, 10 years in total ([8 CFR 214.2(p)(14)(ii)(A)](https://www.law.cornell.edu/cfr/text/8/214.2)). During that period the petitioner "may add additional, similar or comparable performance, engagements, or competitions" without an amended petition ([8 CFR 214.2(p)(2)(iv)(D)](https://www.law.cornell.edu/cfr/text/8/214.2)).

## Who files when a sponsor pays you

An athlete cannot be the petitioner, and an athlete paid by sponsors and prize money may have no U.S. employer to file; the [P-1A page](/temporary-visas/p-1-visa/) lists who can.

For that case, a U.S. agent may file for "workers who are traditionally self-employed or workers who use agents to arrange short-term employment on their behalf with numerous employers" ([8 CFR 214.2(p)(2)(iv)(E)](https://www.law.cornell.edu/cfr/text/8/214.2)). An agent filing for more than one employer must supply "a complete itinerary of services or engagements", with the dates, the employers and the venues (same paragraph), and must show, as U.S. Citizenship and Immigration Services (USCIS) puts it, that it is "authorized to act as an agent for all of your employers" ([USCIS, P-1A Athlete](https://www.uscis.gov/working-in-the-united-states/temporary-workers/p-1a-athlete)). Altius does not act as an agent petitioner itself; it works with agent-petitioner services and can refer you to one.

The X Games League's published FAQ does not say whether a club employs the athletes it drafts; athletes "opt in to the Draft by agreeing to the Club terms", and those terms are not published ([X Games League FAQ](https://www.xgames.com/xgl-faq/)). Bring the club terms to the consultation.

## Where a B-1 visitor visa stops

The State Department's Foreign Affairs Manual allows a B-1 for professional athletes "who receive no salary or payment from a U.S. source other than prize money", provided the athlete's principal place of business is abroad, the athlete's salary "principally accrues in a foreign country" and, in a team sport, the team belongs to an international league or the competition has an international dimension ([9 FAM 402.2-5(C)(4)](https://fam.state.gov/fam/09FAM/09FAM040202.html)). In the firm's reading, a U.S. sponsor's appearance fee, a paid shoot in the United States, or a signing bonus from a U.S.-based club is a U.S.-source payment outside those words.

## Which visa fits which person

- **P-1A.** For competing at a level that is "renowned, leading, or well-known in more than one country" ([8 CFR 214.2(p)(3)](https://www.law.cornell.edu/cfr/text/8/214.2)). The petition needs a tendered contract with a major U.S. league or team (or, in an individual sport, a contract in line with international recognition) "if such contracts are normally executed in the sport", plus at least two of seven kinds of evidence ([8 CFR 214.2(p)(4)(ii)(B)](https://www.law.cornell.edu/cfr/text/8/214.2)). Where your deals are sponsor agreements rather than competition contracts, the petition has to address the contract requirement directly.
- **O-1A and EB-1A.** For an athlete whose own record is the stronger evidence, the [O-1](/temporary-visas/o-1-visa/) is the temporary route and [EB-1A](/eb-1a-green-card-athletes/) the green card.

Raise sponsor content work early. The P-1 event definition includes "promotional appearances for the petitioning employer relating to the competition" ([8 CFR 214.2(p)(3)](https://www.law.cornell.edu/cfr/text/8/214.2)). Film and content work for a sponsor that is not tied to a competition is not named there, so tell us about it before the petition is written.

## Coaches, team managers and filmers

Support staff need a petition of their own. A P-1S essential support worker is "a highly skilled, essential person" who is "an integral part of the performance" and performs services "which cannot be readily performed by a United States worker" ([8 CFR 214.2(p)(3)](https://www.law.cornell.edu/cfr/text/8/214.2)). The P-1S petition needs its own consultation, "a statement describing the alien(s) prior essentiality, critical skills, and experience with the principal alien(s)", and the contract ([8 CFR 214.2(p)(4)(iv)(B)](https://www.law.cornell.edu/cfr/text/8/214.2)). USCIS names "coaches, scouts, trainers, broadcasters, referees, linesmen, umpires, and interpreters" as examples ([USCIS, P-1A Athlete](https://www.uscis.gov/working-in-the-united-states/temporary-workers/p-1a-athlete)); filmers and photographers are not on that list, so a filmer's petition rests on the same essential-support test. For an O-1 athlete, the matching category is the O-2, which requires "critical skills and experience with the O-1 alien that are not of a general nature" ([8 CFR 214.2(o)(1)(ii)(B)](https://www.law.cornell.edu/cfr/text/8/214.2)).

## The consultation letter

A P-1 petition needs a written advisory opinion, or a letter of no objection, from a labor organization unless none exists: a consultation "with a labor organization that has expertise in the area of the alien's sport" ([8 CFR 214.2(p)(7)(ii)](https://www.law.cornell.edu/cfr/text/8/214.2)); an O-1 petition may use "an appropriate U.S. peer group", which the regulation says "could include a person or persons with expertise" in the sport ([8 CFR 214.2(o)(5)(i)(A)](https://www.law.cornell.edu/cfr/text/8/214.2)).

- **Skateboarding** has the only action-sports entry in USCIS's index of consultation sources: Skate Park Association International, in Santa Monica, listed under peer groups for "Skateboarders, skate parks" ([USCIS, Address Index for I-129 O and P Consultation Letters, updated September 11, 2026](https://www.uscis.gov/working-in-the-united-states/temporary-workers/address-index-for-i-129-o-and-p-consultation-letters)). USCIS says the index "is not an exhaustive list" (same page).
- **Surfing, BMX and climbing** have no entry in that index as of its September 11, 2026 update; because the index is not exhaustive, a missing entry does not by itself show that no labor organization exists. Where the petitioner establishes that "an appropriate labor organization does not exist", USCIS decides "on the evidence of record" ([8 CFR 214.2(p)(7)(i)(F)](https://www.law.cornell.edu/cfr/text/8/214.2)).

## Governing bodies and the results that count

- **Surfing.** The 2026 Championship Tour field was set from the 2025 Championship Tour and 2025/2026 Challenger Series rankings, plus wildcards ([World Surf League, 2026 field](https://www.worldsurfleague.com/posts/553283/2026-wsl-championship-tour-field-confirmed-ahead-of-season-opener-at-bells-beach)). Official pages disagree on the U.S. governing body: the list of national governing bodies kept by the U.S. Olympic & Paralympic Committee (USOPC) names USA Surfing ([USOPC](https://www.usopc.org/NGB-IMS)), and USA Surfing announced on April 15, 2026 that the USOPC had certified it, "Certified with Conditions", effective June 1, 2026 ([USA Surfing](https://www.usasurfing.org/usa-surfing-news/usa-surfing-certified-as-the-national-governing-body-for-olympic-surfing-by-the-usopc)). Team USA's surfing page still says USA Surfing "will no longer serve as the National Governing Body" and that the USOPC oversees the program on an interim basis ([Team USA, surfing](https://www.teamusa.com/surfing)). Which body will sign has to be settled before a petition relies on a governing-body letter for a surfer.
- **Skateboarding.** The USOPC lists skateboarding as an Internally Managed Sport, not under a national governing body ([USOPC](https://www.usopc.org/NGB-IMS)). World Skate describes itself as "the governing body for all Sports performed on skating wheels", skateboarding among them ([World Skate, About](https://www.worldskate.org/about/about-world-skate.html)).
- **BMX.** USA Cycling, recognized by the USOPC and the Union Cycliste Internationale, is "the official governing body for all disciplines of competitive cycling in the United States, including BMX" ([USA Cycling](http://usacycling.org/)).
- **Climbing.** USA Climbing is the national governing body on the USOPC list ([USOPC](https://www.usopc.org/NGB-IMS)), and World Climbing, the international federation, publishes world rankings ([World Climbing](https://www.worldclimbing.com/)).

A written statement "from an official of the governing body of the sport" is one of the seven P-1A evidence items ([8 CFR 214.2(p)(4)(ii)(B)(2)(iv)](https://www.law.cornell.edu/cfr/text/8/214.2)); it is separate evidence and does not replace the labor organization consultation. For a skateboarder, with no U.S. governing body, the petition has to explain whose official is writing and why.

## Where the tour's surfers come from

The World Surf League's confirmed 2026 Championship Tour field (published March 16, 2026) names 35 men and 24 women, counting one replacement surfer on each tour; 28 of those men and 15 of those women surf under a flag other than USA or Hawaii ([World Surf League, 2026 field](https://www.worldsurfleague.com/posts/553283/2026-wsl-championship-tour-field-confirmed-ahead-of-season-opener-at-bells-beach)). Among the 2026 tour surfers named in that list, Brazil (9) and Australia (8) have the most men, and the United States (6) and Australia (5) the most women. World Surf League flags are surfing flags, not passports: Hawaii and Euskal Herria appear as flags of their own in the same list. The X Games League's first draft took 40 athletes from eight countries ([X Games, draft rosters](https://www.xgames.com/news/global-action-sports-team-rosters-officially-locked-for-four-x-games-clubs-at-first-ever-moonpay-x-games-league-draft/)). A petition therefore states the athlete's legal nationality, not the tour flag.

## College to professional

None of the four sports appears in the National Collegiate Athletic Association (NCAA) Demographics Database, which counts only NCAA sports: "Only NCAA-sanctioned championship and emerging sports are counted" ([NCAA demographics spreadsheet, published September 2025](https://ncaaorg.s3.amazonaws.com/research/demographics/data/RES_DemographicsSpreadsheetSport.xlsx)). USA Cycling's collegiate program includes BMX ([USA Cycling, collegiate](https://usacycling.org/college)) and USA Climbing runs a Collegiate Series ([USA Climbing](https://usaclimbing.org/)); the P-1A evidence item for "a prior season for a U.S. college or university in intercollegiate competition" ([8 CFR 214.2(p)(4)(ii)(B)(2)(iii)](https://www.law.cornell.edu/cfr/text/8/214.2)) does not name these programs, so a petition relying on one has to explain the competition. The path to paid competition is qualification and selection, not a college draft: the World Surf League tour is filled partly from Challenger Series rankings ([World Surf League, 2026 field](https://www.worldsurfleague.com/posts/553283/2026-wsl-championship-tour-field-confirmed-ahead-of-season-opener-at-bells-beach)), and X Games League clubs draft from athletes who opt in ([X Games League FAQ](https://www.xgames.com/xgl-faq/)).

## Pitfalls specific to action sports

- **Filing too early.** A P petition "may not be filed more than one year before the actual need for the alien's services" ([8 CFR 214.2(p)(2)(i)](https://www.law.cornell.edu/cfr/text/8/214.2)), which matters when the first U.S. stop of the season is more than a year away.
- **Adding a coach or filmer mid-season.** Essential support staff "may not be substituted at consular offices or at Ports-of-entry", and adding new support staff requires a new petition ([8 CFR 214.2(p)(2)(iv)(H)](https://www.law.cornell.edu/cfr/text/8/214.2)).
