Temporary Visas
As the name suggests, temporary visas, also known as non-immigrant visas, are those that grant the right to stay in the United States for a specified period of time and for a well-defined purpose. It is important to note that these visas do not guarantee immigration rights or permanent residence (Green Card).
Temporary visas cover a wide range of purposes, including travel for tourism, study, exchange, participation in artistic performances, journalism or religious activities, temporary work in American companies and various other categories. Some of them, especially those involving certifications and non-immigrant petitions for employment, may require complex documentation.
H-1B Visa (Specialized Worker)
- The H-1B visa is intended for highly qualified foreign professionals who wish to work in the United States in jobs that require a high level of knowledge or technical skills.
- Sponsorship by a US employer is required.
- The H-1B visa is initially valid for three years, with the possibility of extensions up to a maximum of six years.
- H-1B holders can bring their spouses and minor children on H-4 visas.

There is an annual cap on the number of new H-1B visas issued, and candidates must be first selected in the H-1B lottery. Some employers and positions are exempt from the annual H-1B cap and lottery.
L-1 Visa (Intra-Company Transfer)
- The L-1 visa is intended for employees of foreign companies who are being transferred to subsidiaries, affiliates or branches in the United States.
- There are two subcategories:
- L-1A: For managers and executives.
- L-1B: For employees with specialized knowledge.
- The L-1A visa is valid for up to seven years, while the L-1B visa is valid for up to five years.
- No labor certification process is required for the L-1 visa, making it an attractive option for intra-company transfers.
K-1 Visa (Fiancé or Fiancée)
- The K-1 visa is intended for fiancés or fiancées of US citizens who plan to marry and reside in the United States.
- To qualify, the couple must intend to marry within 90 days of the groom or bride entering the USA.
- After the wedding, the fiancé or fiancée can apply for an adjustment of status to obtain a green card and the right to permanent residence.
- It is important to note that the K-1 visa is specifically for fiancés or fiancées and does not apply to other family members.
O-1 Visa (Notable Professionals)
The O-1 visa is a category of non-immigrant visa intended for outstanding professionals in their respective fields. If you are an artist, actor, musician, scientist, teacher, executive, manager, director, producer, athlete, or exceptional professional in any field, the O-1 Visa could be your gateway to the United States. This visa is typically evidenced by a sustained record of recognition, awards, and accomplishments in a given field.
E-2 Visa (Treaty Investor)
- The E-2 visa is for foreign investors who invest a substantial amount in a business in the USA.
- Generally, the investor must be from a country that has a trade and navigation treaty with the United States.
P-1 visa (artists, athletes and entertainers)
The P-1 Visa is a temporary visa granted to prominent artists, athletes and entertainers who wish to perform, compete or participate in programs in the United States. This visa is designed for individuals and groups recognized for their exceptional talent and outstanding achievements in their respective fields.
